you are asked to research and write a legal commentary on that topic. Your commentary must address the following: – 1. Identify the primary sources of law; 2. Identify at least 5 relevant, authoritative secondary sources; 3. Briefly define and describe the legal nature of the topic; 4. Identify and outline the Parliamentary Second Reading Speech; and 5. Outline some of the problems and/or controversies associated with the law, as considered in the secondary sources. This paper will require you to engage in a process of legal research, and will take time to do. The assignment must be no more than 1500 words in length, including footnotes. A bibliography is NOT required. Referencing MUST be in accordance with the Australian Guide to Legal Citation
1. please note that the word count for Assessment 1 (“up to 1500 words”) is a “strict” upper limit in that you are not permitted to exceed that upper limit. Penalties will apply for papers of 1501 words and over.
2. The word count INCLUDES footnotes. A bibliography is NOT required.
3. If a second reading speech is not available for your key piece of legislation, you may note this accordingly and use a second reading speech for an amendment to that legislation. For example, if a second reading speech is not available for an 1898 Act but the Act was amended in 1952, you may use the second reading speech for the 1952 Amendment Act for the purpose of this assessment. The main goal is to introduce you to importance of hansard.
4. If there are multiple key pieces of legislation in your topic area, you may choose ONE second reading speech but please ensure that this is for the MOST RELEVANT statute.
